Partner Visa
As the name implies, the partner visa is for married partners of Australian citizens, Australian permanent residents, and qualified New Zealand citizens to enter and remain permanently in Australia. Married partners include same-sex partners as well as opposite-sex spouses. It is our responsibility at Eden Immigration to take care of obtaining this visa for you through careful evaluation, counseling, and visa application procedure.
Although there are three main subclasses of partner visas, these visas can be essentially categorised into two groups: partner visas and visas for prospective marriages. The kind of relationship you are in will determine the sort of visa you should apply for.
The categories of relationships and the corresponding visas are as follows:
- Intention of marriage (fiance(e)): Prospective Marriage visa
- Currently Married (de jure) relationship: Partner visa
- De facto partner relationship: (including a same-sex relationship): Partner visa
Subclass Partner Visa
There are two different subclasses: temporary and permanent. Partners who meet the legal requirements for the grant of the visa are initially given a temporary visa. If there is a long-term partnership or offspring of the relationship, a permanent visa may be issued after an eligibility period or shortly after the temporary visa is granted.
Additionally, fiances (intended spouses) of Australian citizens, permanent residents, and qualifying New Zealand citizens are permitted temporary immigration into Australia under the Partner Category Migration.
You are not, however, automatically qualified for permanent residence in Australia if you are the partner or fiancé of an eligible Australian citizen, Australian permanent resident, or eligible New Zealand citizen. If you want to live in Australia permanently, you must first apply for a permanent visa and meet the requirements set forth by the law before that visa may be granted.
You can apply for a Partner Temporary Visa (Subclass 820) and Permanent Visa if you are in Australia (subclass 801). This visa allows you to stay in Australia with your partner, who must be a citizen of Australia, a permanent resident of Australia, or a citizen of New Zealand who qualifies. You may be given a permanent visa if the connection is sincere and continues even after the two years have passed since the application for this visa.
Partner Temporary Visa (Subclass 309) and Permanent Visa (Subclass 100), if you reside outside of Australia: This visa allows you to enter and remain in Australia with your partner, who must be a citizen of Australia, a permanent resident of Australia, or a citizen of New Zealand who qualifies. You may be granted a permanent visa if you maintain a sincere relationship for two years following the submission of this application.
Prospective Marriage Visa (Subclass 300)
This is for individuals who wish to travel to Australia prior to getting married. Your fiance must be an eligible Australian citizen, Australian permanent resident, or New Zealand citizen in order to apply for this visa. After being married, those who possess this visa can apply for a Partner visa to stay in Australia permanently.

Additionally, there are character and health requirements.
You must be sponsored by a person who is an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen and who can meet the legal requirements for becoming a sponsor. This person can be your fiancé(e), partner, or in some cases, the parent or guardian of your partner.
If you have dependent children or other family members, they are allowed to submit combined applications with yours as long as they meet specific criteria.
Expansion of partner visa in Australia
Those who have had their visas rejected or cancelled during their previous trip to Australia are also eligible for a partner visa. Section 48 of the Immigration Act of 1958 applies to this denial or cancellation (Act). As a result, you are only permitted to apply for particular classes of visas while in Australia, such as a Protection visa or a Bridging visa.
Since your last entry into Australia, your partner’s visa must not have been denied.
You cannot have had a visa denied or revoked due to your behaviour in violation of Section 501 of the Act.
A form 40SP must be submitted together with your application. Formal documentation stating that a partner is your spouse or de facto partner must be completed and signed by an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen.
Two statutory declarations confirming the existence of your connection with your partner from eligible Australian citizens, Australian permanent residents, or New Zealand citizens (other than your partner) must be submitted with your application. These declarations must be made no later than six weeks after the application date for the partner visa.
These are some of the prerequisites that must be met even to submit an application. There are numerous other requirements as well, and your application under this provision will be evaluated in accordance with them in the same manner as all Australian partners applying for partner visas.
